Terms and Conditions for Witvo Point of Sale (POS) App

These Terms and Conditions ("Terms") govern your use of the Witvo Point of Sale (POS) application and any related services ("Service") provided by Witvo Technologies Pvt Ltd. ("Witvo," "we," "us," or "our"). By downloading, accessing, or using the Witvo POS app, you agree to be bound by these Terms. If you do not agree to these Terms, you may not use the Service.

1. Acceptance of Terms

By creating an account and using the Witvo POS app, you confirm that you have read, understood, and agree to be bound by these Terms. You also agree to our Privacy Policy, which is incorporated by reference into these Terms.

2. Description of Service

The Witvo POS app is a mobile application that provides businesses with tools for managing sales, inventory, customers, and purchases. Key features include:

• Sales and Purchase Management: Track sales and purchases with real-time updates.
• Inventory Tracking: Monitor stock levels and receive low-stock alerts.
• Product and Supplier Management: Manage product details and supplier information.
• Real-time Reporting: Access reports on sales, inventory, and other business metrics.

3. User Accounts

To use the Witvo POS app, you must create an account. You are responsible for maintaining the confidentiality of your account information, including your password, and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account or any other breach of security.

4. Subscription and Fees

Witvo may offer various subscription plans for the use of the POS app. The fees, features, and subscription terms will be disclosed to you at the time of purchase.

Billing: You agree to pay all applicable fees for the subscription plan you select. All fees are payable in advance and are non-refundable, except as expressly stated in our Refund Policy.

Renewals: Your subscription will automatically renew at the end of each subscription period unless you cancel your subscription before the renewal date.

Price Changes: We reserve the right to change the subscription fees at any time. We will provide you with reasonable prior notice of any price changes.

5. Payment Processing

The Witvo POS app may integrate with third-party payment processors to facilitate transactions. Your use of such third-party payment processing services is subject to their respective terms and conditions. Witvo is not responsible for the performance or security of any third-party payment processors. You are responsible for all transaction fees charged by the payment processor.

6. User Conduct and Responsibilities

You agree to use the Witvo POS app in compliance with all applicable laws and regulations. You are solely responsible for all data, information, and content that you upload, post, or otherwise transmit through the Service.

Prohibited Activities: You agree not to:

• Use the Service for any illegal or unauthorized purpose.
• Transmit any worms, viruses, or any code of a destructive nature.
• Violate any laws in your jurisdiction, including but not limited to copyright laws.
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Service without the express written permission of Witvo.
• Engage in any activity that interferes with or disrupts the Service.

We reserve the right to suspend or terminate your account and access to the Service if you engage in any of the prohibited activities.

7. Data and Privacy

We are committed to protecting your privacy and the security of your data. Our Privacy Policy, which is available on our website, describes how we collect, use, and disclose your personal information. By using the Service, you consent to our collection and use of your data as described in the Privacy Policy. Credit card information is always encrypted during transfer over networks.

8. Intellectual Property

The Witvo POS app, including its software, design, and content, is the property of Witvo Technologies Pvt Ltd. and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, and revocable license to use the Service for your internal business purposes, subject to these Terms.

9. Hardware and Software Compatibility

You are responsible for obtaining and maintaining any hardware or software necessary to access and use the Witvo POS app. While we strive to ensure broad compatibility, we do not guarantee that the app will be compatible with all devices or operating systems.

10. Termination

You may terminate these Terms at any time by closing your account and ceasing to use the Service. We may terminate or suspend your access to the Service at any time, for any reason, without prior notice. Upon termination, your right to use the Service will immediately cease.

11. Disclaimer of Warranties

The Witvo POS app is provided on an "as is" and "as available" basis. We make no warranties, express or implied, regarding the operation or availability of the Service, or that the Service will be uninterrupted or error-free. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

12. Limitation of Liability

In no event shall Witvo, its directors, employees, or agents be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to, loss of profits, data, use, goodwill, or other intangible losses, resulting from (i) your access to or use of or inability to access or use the Service; (ii) any conduct or content of any third party on the Service; (iii) any content obtained from the Service; and (iv) unauthorized access, use, or alteration of your transmissions or content, whether based on warranty, contract, tort (including negligence), or any other legal theory, whether or not we have been informed of the possibility of such damage.

13. Indemnification

You agree to defend, indemnify, and hold harmless Witvo and its licensee and licensors, and their employees, contractors, agents, officers, and directors, from and against any and all claims, damages, obligations, losses, liabilities, costs or debt, and expenses (including but not limited to attorney's fees), resulting from or arising out of a) your use and access of the Service, or b) a breach of these Terms.

14. Governing Law

These Terms shall be governed and construed in accordance with the laws of India, without regard to its conflict of law provisions.

15. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.
